    The Ministry of Justice and Public Security has adopted a new sixth paragraph to section 14-3 of the Immigration Regulations, effective 1 September 2017. The amendment entails that section 14-3 fifth paragraph (which provides for abeyance where the foreigner is protected against return, cf. Immigration Act section 73) applies when an Expulsiondecision appears disproportionate pursuant to section 70 of the Immigration Act, if there are realistic prospects that expulsion will not be a disproportionate measure at the time of expulsion of the foreigner or the special reaction ceases. Thus, there is no requirement for probability overweight for such change. Abeyance will primarily be applicable in cases where the foreigner is subject to long-term imprisonment or special reaction, including custody.
