Guidelines on international protection no. 13: Applicability of Article 1D of the 1951 Convention relating to the Status of Refugees to Palestinian Refugees


These guidelines complement the UNHCR Handbook on Procedures and Criteria for Determining Refugee Status under the 1951 Convention (Geneva: UNHCR, 1979; reissued 2011) and other Guidelines on International Protection. Note on UNHCR's Interpretation of Article 1D of the 1951 Convention relating to the Status of Refugees and Article 12(1)(a) of the EU Qualification Directive in the context of Palestinian refugees seeking international protection, May 2013, remains applicable.

    New analysis by the United Nations High Commissioner for Refugees. Article 1D of the 1951 United Nations Refugee Convention applies to Palestinian refugees. Article 1D has both exclusion and inclusion aspects: paragraph 1 generally excludes those Palestinian refugees who are receiving protection or assistance from UNRWA from the protection of the 1951 Convention, while paragraph 2 includes those very same Palestinian refugees when that protection or assistance has ceased. At this point they are entitled ipso facto to the benefits of the 1951 Convention. Article 1D has two related purposes: to ensure that Palestinian refugees continue to be recognized as a specific class, and to avoid duplicating and overlapping competencies between UNHCR and UNRWA.
